Welcome to Daival. These Terms and Conditions (“Terms”) generally govern your use of the website www.daival.in (“Site”) and the purchase of products from Daival, a unit of R & R Foods and Spices (“We”, “Us”, or “Our”).

By accessing or using the Site, you agree to be bound by these Terms in accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. If you do not agree to these Terms, please do not use our Site.

1. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence (18 years in India) and you have given us your consent to allow any of your minor dependents to use this site.

2. Product Accuracy & Natural Variations

We sell agricultural produce (Spices). While we strive to display colors and images accurately:

• Natural Variation: Spices are natural products. Slight variations in color, texture, or aroma may occur between different harvest batches. This is not a defect but a sign of natural authenticity.
• Appearance: We cannot guarantee that your computer monitor’s display of any color will be accurate.

3. Pricing and Modifications

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

4. Billing and Account Information

We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

5. Cancellation, Return, and Refund Policy

• Cancellations: You may cancel your order before it has been shipped. Once shipped, the order cannot be canceled.
• Damaged/Defective Items: If you receive a package that is open, damaged, or tampered with, please do not accept it. Take a photo and email us at contact@daival.in within 24 hours. We will arrange a replacement or refund.
• Refund Processing: Approved refunds are processed within 7-10 working days to the original source of payment.

6. Health Disclaimer & Allergens

Daival products are manufactured in a facility that handles spices. While we maintain strict hygiene:

• Allergen Warning: Our facility may process ingredients containing wheat, nuts, mustard, sesame, or soy. We cannot guarantee that our products are 100% free from trace allergens due to potential cross-contamination.
• Dietary Advice: Information on this site is for general purposes and is not a substitute for professional medical advice. Please read product labels carefully before consumption.

7. Limitation of Liability

To the fullest extent permitted by applicable law (including the Consumer Protection Act, 2019), R & R Foods and Spices shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

8. Indemnification

You agree to indemnify, defend and hold harmless Daival (R & R Foods and Spices) and our partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if the delay or failure results from events beyond our reasonable control, including but not limited to acts of God, war, riots, civil commotion, floods, fire, or failure of logistics partners.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. You agree that the courts located in Ahmedabad, Gujarat shall have exclusive jurisdiction over all disputes arising under these Terms.
